Can a non-rational bein have positive rights?

Apparently in parts of California dog-owners are fighting for the right of the dogs to run free in parks; essentially they claim that leash laws are restrictive of doggy rights. But dogs are not capable (so far as we know) of comprehending the concept of rights, nevermind that they are being denied them. As sad as you think your dog might be having to stay on a leash, is his persuit of happiness really that impeded (and does he have a right to that persuit)?
